Judicial Misconduct

Please respond to the following:

Assess the importance of a judge's role as an impartial actor in the pursuit of justice. Suggest two (2) scenarios where a judge's discretion-or lack thereof-may have led to disparate outcomes in a trial. Support your response with examples of judges in such a role.

Suggest two (2) possible sanctions that a judicial sanctioning board could impose against a judge who has accepted a bribe while presiding over a case. Describe two (2) techniques that you believe would be appropriate to use for removing a judge guilty of such conduct from the bench.

Part 1. From the first e-Activity, analyze the role of judges in our adversary system, and describe the procedure for the selection of the U.S. Supreme Court judges. Select the judicial selection method that you believe provides the greatest result-selection by merit or by election. Justify your response.

Part 2. You may choose to answer option 1 or option 2 here:

Option 1: From the second e-Activity, compare your state's judicial selection process with that of the federal judicial selection process. Point out the differences that you believe exist, and provide a rationale for your response.

Option 2: Watch the video and read the article at: Trump backs off tough stand on green-card holders

Right now we have a real-life example of the act of judicial review occurring in a conflict between the executive and the judicial branches concerning the Executive Order: Border Security and Immigration Enforcement Improvements issued by President Trump on 1/25/2017. This order bans immigrants from 7 specific nations from entering the United States for the next 90 - 120 days.

However, on Saturday night, a federal judge granted an emergency stay of the order for people who have already arrived in the United States and those who are in transit, and who hold valid visas, ruling they cannot be deported. Since then, additional federal judges have weighed in on the question of whether the Executive Order is unconstitutional. Pulling in concepts from your Marbury paper, and research from outside sources, discuss the role of the federal judges in this case.
