The Cunninghams contracted with Crites to have him build their house for $105,000. They were to pay their own closing costs and get a credit at closing because they owned the land on which the home was constructed; Crites was to receive a builder's fee of $12,500. The closing date was October 30, but the house was not finished until February. They met in January to discuss the closing and outstanding bills. They agreed the Cunninghams would pay $10,000 of bills, and Crites would drop the builder's fee. Crites failed to appear at the closing and asked for the builder's fee.
