Lou Manchise is a waiter and union employee of a new and upscale restaurant at Newport on the Levy. The International Restaurant Workers (IRW) represent the employees. The IRW will arbitrate a discipline or discharge grievance if they believe Manchise is being unjustly treated. After two months of employment, Manchise shouted out to a customer who was leaving the restaurant you are cheap! The customer left only a two percent tip. Manchise's outburst was caught on the security camera. The customer, a regular patron, has not returned to the restaurant since the incident. Manchise, up and until this incident, did not have any disciplinary warnings. Other customers heard the outburst.

After four months of employment, Manchise on three occasions reported to work with rumpled clothing and unshaven. The work rules posted in the Employee Handbook, given to Manchise on day one of employment, state: "Employees must appear neat and tidy". His supervisor, after the first rumpled and unshaven appearance, requested Manchise shave and dress more professionally. Manchise obviously ignored the supervisor's request two more times. At this very moment in time the restaurant is having a lot of difficulty filling two waiter positions. You just asked Manchise to come into your office.

After six months of employment, Manchise organized a sports gambling pool at the restaurant from which he kept 5% of the pool money. Manchise never mentioned to the other union employees he was going to keep 5% of the pool. Today you learned about the five percent take from Manchise's former girlfriend, who also serves tables on a different shift at the restaurant. They are no longer on speaking terms. She thinks Manchise is a jerk! Gambling is not referenced in the Employee Handbook.
