Roger worked in an office that prohibited use of company telephones for either local or long-distance calls. Despite this, he did occasionally use the phone to call his children at home with a babysitter, because he was a single dad with sole custody. During a routine audit of phone conversations designed to assure compliance with the requirement not to make personal phone calls, Roger was discovered talking to his children on the company phone, and the company then immediately hung up. When Roger got off the phone, he was fired. He sought to get his job back on the basis that his privacy had been violated. Will Roger likely prevail against the discharge? A.
