Your firm represents Client Jim Smith, who faces criminal charges relating to fraud. He is also the defendant in a civil suit arising from a property dispute involving the same matter. Your firm also represents him in the civil suit. You have handled research on Smith's behalf in both cases. The plaintiff in the civil suit has subpoenaed you as a witness to question you in court regarding information Smith told you about the transaction that underlies both the criminal and civil cases.
