Part 1. Toronto Electric Ltd.case study.

Toronto Electric Ltd. is an electrical contractor that does work in the residential construction industry. Most of the company's work is contracted to them by non-union construction contractors. The company pays wages that are approximately 20% lower than the unionized rate of pay, and offers minimal benefits to employees only after six months of uninterrupted full-time work. The Electrical Workers Union (EWU) started a union organizing campaign at Toronto Electric. The executive of Toronto Electric had expected an organizing effort, but that did not make it any less challenging to them. Shortly after the organizing effort became public knowledge, the President of Toronto Electric Ltd. said at an employee meeting that he:a

A) "Could not compete in a union market and the company would have to close its doors if the union was certified." When individual employees later approached the President and asked him about his thoughts on the union organizing campaign, he emphatically stated that he:

B) "Just did not like the EWU." Then, in a further response to the organizing campaign, the company President also sent a letter to all employees making the following points:

C) Employees and management were part of a team, and the company had been successful with people working together.

D) Certification of the union would mean that employees would have to pay union dues

E) Certification of the union would mean that the company would be on shaky ground because it would now be competing in a new unionized market.

F) The company had never laid people off for more than a few weeks in the past.

G) Certification of the union would mean that the company would lose a few good people.

Having reviewed these comments answer the following:

Of the two quoted comments and five written statements made by the President of Toronto Electric Ltd. ("A" through to "G" above), which would be considered legally acceptable, which would be considered legally unacceptable?

Explain why you think each is either legally acceptable of unacceptable. Make sure you clearly identify or include the comments or written statements in your answer. If any unfair labour practices have been committed, what remedies could the union pursue?

How would the union do so and what might the outcome be?
