1. Mann bought a Lincoln Continental Mark IV automobile from Kilbourn American Leasing, Inc. for $6,500 cash. He received by mistake from Kilbourn a title certificate for a similar but different vehicle. Kilbourn later borrowed money from a bank and gave the correct title certificate for Mann's car to the bank as security for the loan. The bank claims that Mann does not have title to the car because he did not receive the title certificate. Was the bank correct? Why or why not? Explain.
