A non-compete agreement is an agreement some organizations ask their employees to sign restricting them from competing for a specific period of time and in a defined geographic area when they leave the organization. Companies use these agreements to provide protection of their operational information and customer relationships. The Unit 10 Discussion provides the opportunity to practice key elements involved with non-compete contracts including legal issues.

Topic 1: Noncompete Agreements

Read the Human Resource Dilemma (see below) regarding Alice’s quandary. She needs some advice. How should she proceed? Specifically, what are your recommendations and why?

After graduation, Alice Miller interviewed and was offered a position with Medical Recruitment Specialists (MRS), a firm specializing in the recruitment and placement of physicians. As Alice started the position, she was asked to sign a noncompete agreement restricting her from opening her own recruitment business or working for a competitor for a period of one year after leaving MRS. Alice signed the agreement. Five years after starting at MRS, Alice and a recruiter from a rival firm decide to open their own recruitment business. On her final day with MRS, Alice’s manager reminds her of the noncompete agreement she signed.
