Robbery is Larceny and Assault combined. It is commonly defined as: "The intentional taking, and carrying away, the property of another, with the intent to deprive them thereof, through violence or the threat of violence."

Facts:

Roberta Brown and her husband Sylvester owned a convenient store in a high crime area in the city of Boston. One evening while the Brown's were working Henry Smith walked into the store with a handgun in his jacket pocket. Henry intended to rob the store. Roberta noticed that Henry had his hand in his jacket pocket and that he was holding something. The Brown's had been robbed a dozen times since they bought the business in 2015. Paranoid because of the crime in the area and because they had been robbed so many times, Mr. Brown said "take whatever you want but please do not hurt me or my wife." Henry proceeded to walk around the counter and he took $573.00 out of the register. Henry left the store. Roberta called the police. Fifteen minutes later Henry was arrested with $573.00 dollars and a .38 caliber hand gun in his pocket. Henry is charged with Robbery. If you were on the jury would you find Henry Guilty of Robbery? Why or why not?
