Case
The case of Pedro and Empresas Carabelitas
After several years at Empresas Carabelitas and a successful performance as an employee, Pedro has sued his company for discrimination based on sexual orientation and workplace harassment. In his complaint, he stated that his colleagues made constant jokes about his sexual orientation, referred to him as a "fag" and left propaganda for psychological therapies on his desk. In addition, his colleagues constantly held activities and meetings to which he was not invited, even when they were discussing issues related to projects in which he worked. Although Pedro spoke with the supervisor about the matter and submitted his case to the Human Resources office, they indicated that they would talk to them, but not to worry about it, since his evaluations as an employee had always been good.
Pedro felt unsupported and submitted his case to the Anti-Discrimination Office in his city. They visited the company, did an investigation and concluded that, indeed, Pedro was in a hostile environment. Empresas Carabelitas was fined and required to develop a training plan for its employees and establish policies against discrimination. Empresas Carabelitas did not comply and Pedro preferred to resign from the company.
