Audrey Kemmelman, a freelance photographer, eneterd a work-for-hire agreement with The Daily Montgomery Central Times Corporation. Duiring the negotiation stages, Kemmelman asked that an ADR clause be added to the contract that would compel the signatories to submit any claim to ADR. The clause stated that, in the event of any dispute, the signatories to the contract would first discuss the points of conflict informally. If after 30 days, no satisfactory solution had been reached, the signatories agreed to submit the problem to the American Arbitration Association, which would assist in selecting an abjective moderator weho would help the signatories decide on an approporaite ADR method.
