Leighton + Costello Lawyers have taken on a new client, Mrs Sue Smith. Mrs Smith has engaged the firm following the termination of her employment. Mrs Smith has provided the firm with the following information:
• Mrs Smith had been working as a full-time sales assistant for Venexa, an insurance company for 6 years.
• Mrs Smith is 38 years of age, she is married to Mr John Smith, and they live at 28 Cos Place, North Ryde NSW.
• Her employment was terminated following two written warnings for failure to attend work.
• She was provided with one weeks' notice of her termination.
• Mrs Smith's employment is covered by the Fair Work Act 2009 (Cth) and she wants to understand whether she has been given adequate notice.
• Mrs Smith has advised that she is currently without a vehicle and will need to arrange public transport for any meetings at the firm's offices.
Mr Philip Gould is your supervising solicitor. Mr Gould has asked you to undertake several activities to support him with Mrs Smith's case. He has instructed you to refer to the Fair Work Act 2009 (Cth), s 117. draft an email to Mr Philip Gould summarising what you have found in the information sources and state whether Mrs Smith received the statutory minimum period of notice from her former employer. If she did not receive the required notice, explain what period of notice Mrs Smith was entitled to receive.
