Ted is in the final year of his Business Management degree. He orders a pizza from The Lame Duck the night before his Business Law exam. The pizza contains rotten pineapple, which was carelessly put on the pizza by Dan, one of Johnny's chefs. The next day Ted suffers food poisoning, but attempts the Business Law exam anyway. He fails the exam and has to repeat the course over the summer. Assume that there is a duty of care and there has been a breach of this duty, discuss what harm to Ted was caused by the breach of a duty of care.
Question 2.
July 14 was not a good day for Yvonne. On that day she went to her friend's (Justine) house for lunch. The day before, Justine's son, Dominic, had kicked his soccer ball through the glass sliding door which opened on to the sunlit patio. Whilst Yvonne was on the patio she stumbled, fell and seriously injured her arm on the broken glass left in the door.
Whilst waiting in the hospital casualty rooms an emergency car accident victim was brought in - Yvonne recognised the "glow in the dark" school bag lying on the end of the stretcher. The bag belonged to her son, Jacques. Jacques had serious spinal injuries and the doctors held grave concerns for his future. Yvonne went into shock and suffered psychological injuries.
Apparently, Jacques had disembarked from his school bus and went to cross the road in front of the bus. The road Jacques was crossing was Pennant Hills Road, a very busy four lane highway. At this time the cars in the two lanes on the other side of the road were stationary and banked up. Jacques stepped out from in front of the bus into a car being driven, at a moderate speed, by Mary.
