BackgroundYou have been appointed as a Clerk to a new judge at the International Criminal Court, Judge Jones. Judge Jones has an esteemed background in criminal law and has acted as the most senior judge in the highest court in her state for the past 10 years. Her appointment to the International Criminal Court was based on her reputation for fairness and impartiality. However she has very little background knowledge of the huge body of case law that has emerged from the international criminal courts and tribunals that have been established since 1993. To help her read into this body of case law, she has asked that you prepare a series of short legal briefs for her on the most significant aspects of the field of international criminal law in general.
Assessment Question
Judge Jones has remarked that some international criminal courts and tribunals established since the early 1990s have jurisdiction to prosecute the crime of genocide. But she is also aware, due to recent reports in the media, that the International Court of Justice can also hear cases concerning genocide. Judge Jones has asked you to start your work for her by preparing a 1000 word legal brief critically examining the differences between the jurisdiction of the international criminal courts and tribunals established since the early 1990s and the jurisdiction of the International Court of Justice with regard to genocide. While Judge Jones has asked you to keep your discussion to 1000 words, she has also asked that you reference the brief extensively so that she can follow up by reading specific passages of relevant cases or by going straight to the best critical analysis in the wider academic literature critically.
