Development of the site:
Learning Outcome 1: Assess the laws used to ensure that construction sites operate safely and consider adjoining land-users.
Learning Outcome 2: Analyse how the law of contract and land law are used to sell and lease land and buildings.
The scenario: You have been provided with drawings by your tutor, for a real construction project. The site is located in one of the busiest areas of Nottingham city centre, with the Old Market Square and the NET tram system in front of the building and many different surrounding land and building uses. The project's client has asked for a detailed written description of the processes involved in ensuring that the construction phase of the work, including dealing with adjoining land uses, is carried out in a professional manner; legally and with consideration for others.
Your client requires you to undertake three main tasks:
A detailed plan for the contractor to reduce the legal impacts of the redevelopment of the site.
A strategy to address the legal and statutory issues associated with the sale of the land to the South West of the site.
An assessment of the impact of land and property law in the development and disposal of the construction project.
Your response should include the following:
How the law of trespass and nuisance relates to the construction industry.
How the laws of occupier's liability and vicarious liability apply to the construction industry.
How land law has evolved to shape modern land ownership and the role of contract law in buying and selling property.
How landlord and tenant law is used to manage property.
How the application of land law and landlord and tenant law control the disposal and use of property.
