St. Stephen Hospital (SSH) is a not-for-profit, 500-bed medical center located in Chicago, Illinois. On January 1, 2010, SSH began the process of implementing a comprehensive computer system in its Radiology Department, including a reporting system for results of radiological examinations. Prior to the implementation exam results were delivered by hand to the physicians who ordered the tests and verified by phone, and the physicians would forward the results to their patients. During this transition phase a new delivery procedure was established, whereby the system automatically updated the patient's electronic record and printed a copy of the test results on the requesting doctor's printer at a predetermined time each day. The Radiology Department had no way of knowing if a provider did or did not receive a hard copy of the report from the automatic printout; the procedure was dependent upon the doctor who was expecting the test results to call and follow up. Doctor Emil Green, a resident of Indiana, is a primary care physician and an independent contractor at SSH. By Dr. Green's own admission, he is not adept with computers and does not like to use them in his practice. He received some training on the new delivery procedures, but did not complete the training due to patient emergencies that took place during the scheduled training sessions.
