Should the targeted employee's response be relevant at all? Should an employer be responsible for monitoring the working environment to a reasonable level, and responding reasonably, if it finds out about an incident? In other words, should the law, recognizing that employers cannot guarantee that no untoward incidents will ever happen, focus only on whether the employer took reasonable steps to prevent unlawful behavior in the first place, and to respond to incidents of which it becomes aware?
