In 1985, Colony Cove Mobile Home Park instituted a new rule restricting residency in the park to persons 55 years of age or older. Current residents under age 55 were permitted to stay, but the rule was enforced against any children born to residents after that point. When two families in the park later had children, they were evicted. The families sued, stating that the Fair Housing Act prohibits discrimination based on familial status.
