Question: The COVID-19 pandemic continues to strain our health care and public health systems. The United States Department of Health & Human Services responded to the crisis in several ways. One involved HIPAA.

Early in the pandemic, HHS made it easier for health care providers to furnish telehealth services to patients by announcing that the agency would not take enforcement action against providers that, in good faith, rendered telehealth services to patients using technologies that were not fully compliant with HIPAA. One could argue that HHS made it easier for health care providers to reach and treat patients by relaxing how it enforced HIPAA. This begs the question: should HHS have done the same thing in other areas? Specifically, do you think that HHS should have suspended HIPAA's individuals rights (notice of privacy practices, request protection, access, amendment, and accounting) during the pandemic to reduce the burden of compliance on health care providers, thereby freeing them to focus on treating patients?
