An electric company sends three employees - a crew leader and two regular employees - out to repair a power line after a hurricane. The employees are required to wear a harness when working more than six feet off the ground. One of the regular employees failed to bring his harness to the worksite. He falls while working on the second story of a house.

Should the employer or employee bear responsibility for the injury? Also, provide the language of a written workplace policy that you believe would prevent future occurrences of the event that led to the injury described in the fact pattern.
