The topic of my project for this class will be self-defense as a criminal defense. Self-defense defense is when a person feels like being harmed by another person and has to break the law to defend himself. For instance, this can be on a smaller scale of someone repeatedly punching a person, and then finally hitting back. Or it can be extreme where a person was coming towards another person with a gun, and they shot them first. I chose this topic because I would like to become a criminal defense attorney. This is a defense I could potentially use in the future, so I think it's important for me to gain knowledge. Schubert used/ looked at the law as an object to mold the social and political outcomes. For example, laws are used to create social norms and make sure there are boundaries around them. For example, disorderly conduct law is a boundary the United States has to ensure their society follows the social norm of acting in a certain way in public. The objective of the law of Desirable Public Policy uphold the concept of the shadow of law by clarifying expectations and creating consequences. This ensures people know the laws and the consequences behind them. In a way, it fails because it doesn't give people the opportunity for informal social control. After all, you can get in trouble with the law if you don't follow these laws. Self-defense defense fulfills Schubert's Objective of law: Desirable Public Policy in multiple ways.
