With the social media page being about another student, it is considered harassment, bullying and intimidation and the student is punished according to the school handbook and policies. With the student filing a lawsuit, it can make things a little messy in this scenario. The student will most likely file a lawsuit like the Kowalski case, where a student sued the school for suspending her because of a social media page she made about someone. Based on this case, I do believe the court would not rule in favor of the student that created the social media page because the page was created and interrupted the school environment, since others were involved in posting on the page. The Kowalski case was a lot like this scenario because it did cause in-school disruptions and students were harassed, therefore Kowalski deserved to be suspended and punished. With the Mahanoy Sch. Dist. v. B.L case, the student won because she made the Snapchat post outside of school hours and not on school premises, therefore she did not interrupt the school environment or threaten anyone with the post she made. I feel like Mahanoy Sch. Dist. v. B.L is different from the scenario provided.
