Question
Sandra owned two adjacent lots with dwelling houses, Greenacre and Blueacre. Greenacre, where Sandra lived, is a fairly large plot of land with sweeping lawns, and is alongside the beach. Blueacre on the other hand does not have much space beyond the dwelling house and curtilage. Three years ago Sandra leased Blueacre to her friend Deidre. In so doing she allowed Deidre to park her car in the garage at Greenacre, which can hold only one car, as she (Sandra) had never owned a car. Deidre was permitted to walk across a track from Blueacre so as to access her car in the garage, as well as to walk across Greenacre to access the beach. Deidre used her car daily and walked to the beach at least four times a week. Knowing Deidre to be very much into fitness, Sandra also allowed her to jog on the sprawling lawns of Greenacre. Last year Sandra renewed Deidre's lease, and in January sold Greenacre to Mogul. Mogul wishes to park his SUV in the garage at Greenacre, and has told Deidre he never wants to see her on the property. Advise Deidre, Using IRAC and case laws.
