You are a sole-proprietor, Safety Consulting Company that is based in the Midwest. You are a member of the ASSE. You have just been hired by a new developer (GM) of home-offices in a commercial park for the design of safety program of the company and to oversee the safety of the employees of the company. Seventy-six units are scheduled to be built in phase 1, and phase 2. Your client has hinted you of multiple million dollar projects coming up in different parts of the country immediately following this very project. The client (GM) told you that he is very pleased with your work so far and intended that he will like to work with you for all of the company’s future projects. During one of your weekly inspections, you discover that the brick mason subcontractor, which is a subsidiary of the developer’s wife company, has not been providing appropriate PPE for his workers to protect them from dust. You asked the subcontractor to provide appropriate PPE for his employees to avoid enforcement actions, but the subcontractor ignored you and continued work. You brought this to the attention of your client (GM), and he says, "Thank you. You are very diligent, as always. I will talk to the superintendent to make changes." You later discovered that no changes were made and the subcontractor’s employees are daily exposed to unsafe condition. Part of your duties is that you have to sign off on all payment requests stating that good safety procedures/program are being followed before payment will be made. The subcontractor’s monthly requisition for payment is on your desk. You must sign and approve the requisition before the bank will pay the subcontractor. What do you do? You must address issues of safety, ethics, code of conduct of ASSE, and the how the action of the safety engineer might affect his/her present and future contract with the developer.
