Assignment: This reaction paper concerns the way cases get to the Supreme Court. Your textbook and the notes explain the reasons the Supreme Court is more likely to choose cases (ripeness, conflict in the circuit courts, and United States as a party to the case) & how the writ of certiorari process works (Rule of Four). Review the following three "cases". Which case do you think the Supreme Court should take based on their own most likely reasons to take a case and why? You must choose ONE and argue for it based on the Supreme Court's criteria AND your preference.

Case #1: US v. Tanner: This case involves the decision by the US immigration services to deport Lloyd Tanner, a British national and star college soccer player, who was brought into the country illegally by his undocumented immigrant parents when he was 7. Tanner applied for DACA during the Obama Administration but was denied based on new regulations by the current president. Several similar cases have been heard and denied by four different circuit courts, who agreed that Tanner should be deported. Protests have been held around the country over the last two months, protesting the policy.
Case #2: Grover vs. Elmo: Grover sued Elmo for copyright infringement for posting his comedy sketches on youtube without his permission. Youtube refused to take them down because they say Elmo has added extra effects to the videos to make them parodies, which are not covered by copyright. This issue has come up in many states over the last few years, and about 2/3 of states have already changed their laws to make sure copyright protection exists even on altered video.
Case #3: Benson v. Stabler: A NY police officer arrests her former partner for abusing his children due to his bad temper. The evidence in the case was seized after Benson found children's drawings of their father hitting them in the family's trash can, which was in their driveway and not put on the curb yet. The circuit courts have had several similar cases in recent years, but they have not all ruled the same way.
