The history of US bankruptcy law is interesting. The Declaration of Independence did not address the issue. The Framers revised the US Constitution in 1787 and gave Congress (the federal government as opposed to state governments) the power to establish “uniform laws upon the subject of bankruptcies…” There have been many changes to bankruptcy law since 1787. Although bankruptcy is a federal issue, what powers and/or restrictions do state governments have in this area?
