Question: A researcher was a tomato genetics stock researcher who had developed and produced a variety of square tomato. The researcher believed that this would revolutionize sandwich-making. On May 1, the researcher orally agreed to sell five tons of this square tomato to a broker for $5,000. The $5,000 was payable on May 31. On May 5, the researcher dictated the agreement to his secretary. When the secretary typed up the contract, she inadvertently typed in $4,000, instead of $5,000, as the price. Neither the researcher nor the broker noticed the omission or the mistake in the purchase price. Both signed the agreement after it was typed. The broker refused to pay more than $4,000 for the square tomatoes.
