Ken works at Superior Manufacturing, a supplier of jet engine components to the federal government and aircraft manufacturers. Ken, along with other employees at the Superior Manufacturing factory, is subjected to a drug test. If he refuses, he is told he will be fired. He submits to the test which comes back positive and Ken is fired. Ken sues Superior Manufacturing, claiming retaliation and violation of his right to be free from unreasonable searches under the fourth amendment of the U. S. Constitution. Is he right about these claims? Why or why not?
