Kate is a civil engineer. On 1 February she is contracted by ABC Civils Pty Ltd on a once-off basis to design plans for a main road that requires urgent repairs after the floods. The company will pay her a fixed amount for her work upon completion of the plans. The plans must be finished within 60 calendar days from the date of signature of their agreement. The company must, however, first provide her with topographical maps of the area to enable her to commence with and complete the plans. 1. Kate does not make progress with the plans and delivers nothing within the set time limit.

3. Kate completes the plans on time but not for the designated strip of the main road, but for a farm road that runs alongside the main road.

4. The company does not provide the topographical plans to Kate, which means that she cannot draw the plans.

5. The banking details that Kate provided to the company are incorrect as she negligently wrote down her telephone number. They tried but could not pay her. Identify the form of breach of contract that Kate commits.

6. On 1 October Kate is offered a better employment position in Australia. She calls the company and tells them that she is "on her way, sorry but that is that."
