Amber Ho worked as a customer service representative in the billing department of Cisco, Inc. when questions arose about Ho's performance on several occasion, department manager, Lucy Chi met with Ho to discuss, among other things, Ho's personal use of the business phone. Chi reminded to that company policy prohibits excessive personal calls and that these would result in the termination of her employment. Chi began to monitor Ho's phone usage, noting lengthy outgoing calls on several occasions, including some long distance calls. Eventually, Chi terminated Ho's employment, and Ho filled a suit in a federal court against Cisco. Ho asserted in part that in monitoring her phone calls, the employer had invaded her privacy. Cisco asked the court to dismiss the claim. In whose favor should the court rule, and why?
