After some research, I found that more than 18,000 local jurisdictions (counties, cities, boroughs, certain districts) exist in the United States, and each one of them has some legal authority to regulate in the interests of protecting the public's health. Considering the basic principles of administrative law, the power to both set and enforce standards is dependent on the existence of a governmental entity with delegated legislative authority and the power to act. The nature and scope of enforceable municipal public health ordinances are related to the existence of of local health departments or agencies. Law can uniquely impose enforceable duties on both public bodies and individuals. If implementation of public health strategy requires assurance that an action or activity has been performed, law is the most appropriate mechanism for achieving performance. For example, Communicable Disease Control, is reliant on data as to the prevalence and incidence of disease, and many states have within their public health armory laws which impose duties of disease notification.
