1. This is never the case- the NLRB does not have the power to compel recognition.

2. The number or severity of employer Unfair Labor Practices made it impossible to conduct a fair, impartial election.

3. A majority of employees testify that they want voluntary recognition.

4. The first election conducted was inconclusive.
