ASSIGNMENT BRIEF - Conduct an analysis and re-write of the Plaintiff's Statement of Claim for a defamation case in a Queensland District Court, with regard to the Uniform Civil Procedure Rules 1999 (Qld) (UCPR). The case relates to a divorced couple with two children. The ex-wife has defamed the ex-husband on multiple occasions. The ex-husband is a music teacher at Brigidine College and their two daughters also attend this school. There are four instances of defamation:

1. To the school principal and eldest daughter;

2. To the eldest daughter;

3. To the Family court and;

4. To the Magistrates Court).

Significant loss of child custody, job loss, and loss of paternal relationship occurred. The student will re-write the Statement of Claim in order to disclose a reasonable cause of action, to properly and adequately particularise the pleadings (by asserting legal conclusions with material facts), and to properly particularise the damages claimed. The student is allowed to make up any further material facts (needed) in order to make clear the case the Defendant has to answer.
