Molly is owner of a house situated on the ground floor in Tseung Kwan. The house is partitioned into two portions, A and B. Behind a house is a garden which could only be accessed via portion A. The layout of the house gives the impression that the garden is part of house but in fact it is not a part of house. It is a common area.

Michelle was interested to buy the house and during the reviewing of house, Molly did not tell Michelle that garden is not part of the house. Michelle enters into sale and purchase agreement and the documents of the title were supplied to her. The plan showed that the garden is not part of the house.
