You are the judge determining Mark's sentence on his public intoxication charge. In consideration of Mark's previous issues with alcohol, and to discourage him from future drunken incidents, you are thinking of having him spend the next 12 months in a halfway house. A sober-living halfway house would offer Mark a chance to treat his issues with alcohol and prevent further criminal behavior on his part. While in the halfway house, Mark's behavior will be continually monitored, and he will have an in-house counselor to help him if he thinks about taking another drink. As a less expensive alternative, you are considering a sentence of probation. This will give Mark the chance to continue with his current employment and save the expense of a halfway house. Once on probation, Mark will be required to take alcohol and drug testing. He will also need to check in with a probation officer who is trained to monitor Mark and his behaviors while on probation.
