A Discussion on the Legal and Ethical Aspects of a Mayor's Decision to Impose Public Health Mandates During an Epidemic

Project Overview:
The prompt for your paper is: A mayor, during an epidemic, wants to create mandates around behaviors such as quarantines, curfews, and other restrictions. The governor has banned local governments from creating such policies, but the City Attorney has opined that the mayor may have the legal authority to impose the restrictions the Mayor would like. The mayor, though, asks you, her public health advisor, for advice. Based on your basic understanding of the legal issues at play, can the mayor pass such policies, and if so, which one(s)? And if the mayor can (or can't), should she?
Paper Components:
1. Risk Mitigation: What risks and benefits are there in doing as she would like and imposing restrictions the governor has banned?
2. Sources of Authority: Can the major create such mandates? At minimum, you should include a discussion of preemption and home rule, but you can use other principles as well.
3. Ethics: What reason(s) would the mayor have for doing so even when the governor does not? Should she do so? Why or why not?
Paper Formatting:
1. Your report should be fully referenced using primary data sources or reports.
2. References should be formatted using APA 7th Edition format (Author/Year).
3. Your paper should be 1.15-spaced (MS Word default) using Times New Roman, Garamond, Georgia, or Helvetica 11-point font and 1" margins.
4. Include page numbers at the bottom of the page, and also include a cover page with title and name.
5. This paper will be 4-5 pages in length, plus references. Please proofread your submissions for quality of writing and formatting.
6. For optimal organization and flow, I suggest organizing papers using subheadings such as "background," "risks," "benefits," and "conclusion and recommendations."
