You are an HR consultant with your own consulting firm. Two clients came to see you with different work related problem. Advice the clients regarding their rights in the given situation based on the provisions of Employment Act 1955.

a) Asfar works as warehouse technician at Greenloft Sdn Bhd earning a basic salary of RM 1170 per month. Since the company is operating seven days a week, Asfar is given Wednesdays as his rest day. In September 2015, Malaysia Day falls on a Wednesday. At 6.00am on 16 September 2015 Asfar received an urgent call from his employer informing him that he is required to report for duty to do urgent repairs on a sorting machine. Asfar started working from 8.30am to 5.30pm which is his normal working hours but was then requested to stay until 7.30pm to ensure that the machine works without further problems.

On 17 September 2015 Asfar did not report for duty because he assumed that he will get a replacement leave because he was required to work on his rest day. On Friday 18 September 2015 Asfar received a call from his mother informing him that his cousin passed away so Asfar rushed back to his hometown in Johor. Before going back Asfar called Zain his colleague asking Zain to inform his supervisor about his absence. When Asfar reported back for duty on 19 September, he was surprised to learn that his company wishes to take disciplinary action against under Section 15(2) him for being absent without leave.
