This means that mental health providers in Texas are not legally required to warn or protect both known and intended victims when a client poses a serious threat of violence. However, they must still abide by ethical standards and may decide to take action if they think a client poses a serious risk.

Thus in, Texas a psychotherapist who acts on a duty to warn and/or protect when a client expresses the intent to harm another individual would be violating Texas Law and placing her or himself at great legal risk.
