Al owned Blackacre, a ten acre parcel, in fee simple absolute prior to 1975. In 1980, Ben began using approximately one acre of the property for a community vegetable garden. Each spring he planted vegetables, invited others in the area to work in the garden, and harvested throughout the summer and fall, giving some vegetables to the neighbors and keeping some for himself. After Ben moved to another nearby town in 1990, he asked Carl to take over the vegetable garden. Carl was pleased to do so and agreed to pay Ben $100 a month for the privilege. Carl ran the garden in much the same manner as Ben had. Al who was aging, suffered a stroke in 1993, and was not able to leave his home until his death in 1995, when he died, leaving the property to his daughter Madonna. In 2005, Madonna sued Carl to have him evicted from the property. The jurisdiction has a 20 year statute of limitations on ejectment, and extends to an additional five years after the end of the disability in existence when claim accrues.
