In order to be successful in any court or tribunal, the parties must have proof of what they are alleging against each other. Many workplaces have documentation policies, which are extremely important when a legal dispute occurs. Please watch Employment Law: Documentation and Progressive Discipline. As you watch the video, please do not focus on any of the laws that are mentioned, but rather on the principles that are discussed. While the law in the video is American, we have similar legislation here.

Do you have a documentation policy (or does your progressive discipline policy include documentation expectations?)? Is the documentation policy followed? If you had to hand over an employee file to a lawyer, what would most likely be in it? Do you have an employee handbook? Why or why not? What recommendations would you make to your employer for policy or training purposes? From a legal perspective, why is documentation important?
