Question 1: Even though there have been some high-visibility cases in recent years, the number of raids and fines on employers who hire undocumented workers is small, some would say symbolic. This is in spite of a federal law on the books for almost 25 years (the Immigration and Control Act of 1986) whereby employers can be fined $10,000 for every illegal alien they hire, and repeat offenders can be sent to jail. Some equate these immigration laws to the federal "dry laws" of the early 1930s, which prohibited alcohol use yet were widely disregarded and simply spurred more underground activity and a cottage of intermediaries who benefitted from this illegal activity by satisfying an unmet demand. Do you agree? What proposals, if any, would you make to remedy this legal incongruence (that is, laws that are not applied or weakly applied in practice)? Explain.
Question 2: Many U.S. computer companies fear that if they do not hire foreign talent, then competitors in other countries will. What is your position on this? Explain.
Question 3: More companies are embracing outsourcing of all or most of its human resource management activities. Do you agree or disagree with this trend? What risks is a company taking when it decides to outsource its entire set of human resource management activities? Describe a situation where it is most beneficial to retain most of the human resource management activities within a company.
Question 4: From the organization's perspective, what are the drawbacks to using flexible work hours? Compressed workweeks? Telecommuting? How should the HR department deal with these challenges?
Question 5: An increasing number of firms discipline employees for smoking, and some conduct random testing to check for nicotine use, even if such use takes place on the employees' free time. Do you think a company has the right to monitor and punish for behaviors that may increase company costs, even if they are legal and carried out outside normal working hours? Why, or why not?
Question 6: Women and ethnic minorities are often lumped together as a single class. What do these two groups have in common? How do they differ? Explain.
