Bert potentially makes an offer of his own when he says that he will, "do it for half what you're (Vinnie) offering those other losers." Using the aforementioned definition of an offer above one might argue that if Vinnie accepted, than he would have a contract for employment for $100 dollars a night instead of $200. Though Bert never specifies any other terms of the contract, his intent, judged by a reasonable person, would be to form a contract on the terms Vinnie over the phone, except taking half the pay. Even with this being a likely offer, Vinnie rejects this offer by stating, "Are you crazy! No way I'm letting you near a microphone." The offeror has the power of the offer and the ability to revoke the offer at any time up until acceptance. "No way I'm letting you near a microphone," is direct rejection of Bert's offer and therefore voids the offer. The facts state that many hours later Vinnie apologizes to Bert and states that he accepts Bert's offer. However, his previous rejection of the offer destroys that offer making Vinnie's later acceptance it unenforceable.
