From 1970-1995, Suzanne Sinclair (Sinclair) was the owner in fee simple absolute of the Wood County, Ohio property she referred to as Ranch Sinclair. The ranch was in Sinclair's family for almost 100 years, but Sinclair never lived on the property. On this ranch is a weather-beaten old house. In 1993, Sinclair's friend, and our new client, Fulton, asked Sinclair if he, Fulton, might move into the house on Ranch Sinclair. Sinclair grants the request and Fulton moves in. In 1995, Sinclair sells the ranch to Bev Barker (Barker) and does not notify Barker of Fulton's occupancy. Barker lives in Utah but someday hopes to move to the area. Fulton knew nothing about Sinclair's sale to Barker and continued to occupy the house. Fulton, during his whole period of occupancy, thought he was occupying the property with Sinclair's permission. On August 15, 2023, Barker discovers Fulton's occupancy of the house and demands that he leave the house. Fulton refuses to leave and tells Barker that he believes the property is rightfully his.
It has been years since I reviewed Ohio's adverse possession laws, so I need you to bring me up to speed. Please prepare a legal memorandum. Be sure to include the type of complaint we are to file and any relevant ORC statutes. In addition, please send the client a letter asking him to send me any photographs he has of the property and a list of the routine maintenance he conducted on the property over the years.
