Sam’s Plumbing, Inc., owes Finet Company $8,500. Sam’s Plumbing enters into a contract with Jayco Leasing Inc. under which Sam’s Plumbing promises to fix plumbing needs on Jayco Leasing Inc.’s property. Under the contract, Jayco Leasing Inc. promises to pay Finet the amount that will be due Sam’s Plumbing until Sam’s Plumbing’s debt to Finet is paid. Sam’s Plumbing performs as promised, but Jayco Leasing Inc. does not pay Finet. Can Finet succeed in a suit against Jayco Leasing Inc.? Why or why not?
