Kanavos v. Handcock Bank and Trust (Mass, 1982) Facts: Plaintiff was a decade-long bank customer and had dealt with the same banker-Brown-at least twenty times during that period. Brown was the chief loan officer for the bank which had fifteen branches; Brown's office was in bank headquarters, opposite the bank president's, with whom Brown conferred regularly in plaintiff's presence; the president always backed up Brown on these occasions Brown had an important-looking office and a private secretary. Brown wrote plaintiff a letter on bank letterhead confirming a modification of a deal (the second modification Brown made) which would garner plaintiff significant money upon the sale of some real estate. The defendant bank repudiated the contract modification, asserting Brown had no authority to make it. Procedure: Trial court gave summary judgment to defendant bank, plaintiff appealed to the intermediate appellate court, lost, and then to the state supreme court.
