SCENARIO ONE: Jennifer Anistown, 8 months pregnant, came to the outpatient urgent care offices of Callous Clinic, located in the State of Flux, bleeding and with some labor pains. The physician there, Dr. Jones, had never seen or treated her. When called by the nurse, Dr. Jones came out to see the patient and told her that she needed to go to her own physician, which at the time, was 30 minutes away. During travel, Ms. Anistown lost the baby. She brought suit for malpractice negligence against Dr. Jones, attaching her employer, Callous Clinic. SCENARIO TWO: George Clonebee interviewed and was offered contingent employment with UPX, a delivery service. UPX hired Dr. Pratt to examine all potential employees for physical fitness to perform their job duties. Dr. Pratt performed the examination and deemed Mr. Clonebee fit for the job in his report to UPX. Dr. Pratt did not mention an unusual mole he saw on Mr. Clonebee's back. Six months later, Mr. Clonebee was diagnosed with advanced melanoma.
