There are very few aspects of human resource management and employment within an organization that are not governed by laws and regulations. Performance management is no exception to that rule. These systems are in place, not only for the benefit of the organization but for the employee as well. If an organization finds that an employee falls short of expectations or lacks a necessary skill and is underperforming in his or her position, a company must identify training options or alternative employment opportunities within the organization. Consider what other laws and regulations exist to govern performance management programs.

The legal aspects associated with performance management programs and the process of performance appraisals can range from one state to another and across international boundaries. What measures would you need to undertake to ensure that the program is continuously compliant with all relevant laws? How could yousafely address employee issues governed by these laws without violating them? What types of consequences exist if an organization is found to be in violation of these laws?
