Peace has a client who has a second family that her husband is not aware of. The client is hoping to leave a proportion of her estate to the family but does not want her husband to discover the family after her death. Peace is aware that there is an instrument called a Secret Trust but believes this may breach the formalities of s9 Wills Act 1837 and therefore is concerned there is no justification for allowing them to be valid. Discuss and critically analyse this statement with reference to academic arguments and relevant case law. If relevant, propose any changes to the law you would suggest are made.
