Amber and her boyfriend Frederick lived together in a house owned by Amber. After Frederick paid off her mortgage balance, Amber signed over title to her house by quitclaim deed. Two months later they reconciled. However, Amber refused to move back into the house unless Frederick granted her an undivided one-half interest in the house. So Frederick wrote up an agreement stating that the couple were “equal partners” in the house and providing terms for how the property was to be divided in the event of a future break-up. Is resuming a romantic relationship and moving back in with a partner adequate consideration to support a contract? Please discuss whether the contract is enforceable.
