Benhabib characterizes the "paradox of democratic legitimacy" as follows:

Democracies are (1) systems of self-governance and (2) systems that respect human rights. These two commitments are sometimes in conflict-the majority sometimes votes for policies that undermine the commitment to human rights. For example, they fail to fully fund education or healthcare. Benhabib claims that there is a corollary at the global level. Human Rights Law applies to all persons, but not all cultures honor these rights. How, then, can they both self-govern and respect human rights? The US helped create the ICC, but it has not ratified the Rome Statute, and thus it is not subject to it. In this discussion board, please explain why the US has not ratified the ICC (or why you think they have not ratified it)? How does the US action as both the creator of the ICC and a dissenter of the ICC reflect the paradox?
